Residency
Filing for divorce in Georgia requires either you or your spouse to have been a resident of Georgia for at least six months.
How to File
You’ll write a complaint, or petition, that explains everything from your current living situation to arrangements made for your children, shared assets and debts, and why you’re filing for divorce.
There will be fees to pay, documents to properly complete, documents that need to be notarized, and more. When you work with a divorce attorney in Atlanta, they can help you make sure you do everything correctly.
Where to File
If you live in Georgia, then you’ll file your petition in the Superior Court in the county where you live. If you don’t meet the residency requirement but your partner does, then you’ll file in the Georgia county where your spouse lives.
Aspects to Consider
If you and your spouse agree on all terms of separation (child custody, division of assets, etc.), then your divorce may be granted in as short as a month. The time can vary immensely, however, depending on how much you agree on. Below are other serious aspects to be aware of and understand when filing for divorce:
- Grounds for Divorce – abandonment or desertion, adultery, cruel treatment, drug addiction, impotence, irreconcilable differences, mental incapacity, and pregnancy by another man
- Child Custody – a divorce attorney can help you work toward a desirable solution for child custody
- Child Support – a divorce lawyer can help make sure your children are supported financially
- Name Change – you may restore your maiden or prior name if desired
- Property Division – work with a divorce attorney to make sure property is divided fairly
- Spousal Support or Alimony – you may be entitled to receive or required to pay alimony
